| EU court revives US-Czech battle over 'Bud' beer |
| Luxembourg, 29.03.2011 |
 |
| Luxembourg - The European Union's highest court on Tuesday ordered a legal review of a case involving the use of beer trademark "Bud", reviving a long running trans-Atlantic battle.
The dispute between the US-based brewer Anheuser-Busch and the Czech brewer Budejovicky Budvar began in the mid-1990s, when Anheuser-Bush attempted to register the trademark in the EU.
In 2008, Budejovicky Budvar won its bid in the EU General Court to have a decision by the EU's trademark registry decision granting Anheuser-Busch EU protection over the "Bud" trademark scrapped.
The court accepted the Czech brewer's argument that it had already registered the trademark in several EU states, including Austria, France, Italy and Portugal.
But on Tuesday, the Court of Justice - the EU's highest appeal court - ruled that "the General Court's judgement contains three errors of law" and ordered the case back to the General Court "to give judgement afresh".
Anheuser-Busch is owned by Belgian-Brazilian multinational InBev.
The two companies have been waging a separate battle over the use of the use of the "Budweiser" trademark. Last year the General Court prevented Anheuser-Busch from registering it as an EU trademark because its Czech rival had staked a prior claim to it.
