The register of land use relations should simplify procedures for direct agricultural support. This was stated by the submitter of the bill - the Ministry of Agriculture and Rural Development (MPRV) of the Slovak Republic, which should be discussed by the Economic and Social Council (HSR) of the Slovak Republic next week on Monday (18 August). The law should be effective from 2028 due to technical preparation, implementation and testing, as well as due to the financing of the register.
According to the MPRV, the extract from the register will serve the Agricultural Paying Agency (PPA) as a basis for administering applications for a single area payment for the area of agricultural land managed by applicants, which is kept in the LPIS (Agricultural Land Identification System), although the register itself is based on information about land kept in the real estate cadastre.
"The aim of the bill is to create a register of land use relations, which will significantly contribute to the transparency of land use relations and significantly simplify the process in the procedure for direct support," the Ministry of Agriculture specified.
According to the MPRV, the register will contain data on land use relations used for agricultural purposes in order to provide a relevant basis for the payment of direct support. Data on the use of forest land will not be entered into the register if these lands are not used for agricultural production.
"The bill will also not affect the provisions of special regulations that regulate the obligations of registering land for other purposes, such as the Forest Act or the Cadastral Act. For the purposes of the bill, a user is considered a person who actually uses the land," the Ministry of Agriculture emphasized.
According to the MPRV, the bill regulates the establishment of the register, the content parts of the register, data on the user, data on the land and data on the right of use to the land, which will be entered into the register. The draft also regulates the public nature and reliability of the register data, data on the usual amount of rent that will be part of the register, the procedure for entering data into the register, the competence of state administration bodies, as well as offenses and sanctions for violating the defined obligations.
The Ministry of Agriculture added that the draft law contains, for example, amendments to the Act on Lease of Agricultural Land, the Act on Provision of Support and Subsidies in Agriculture and Rural Development in order to harmonize their legislative framework with the register.
