Slovak legislation on subsidies in agriculture harms EU finances

The European Public Prosecutor's Office (EPPO) published a statement on its website on Tuesday regarding legislative changes in the area of ​​providing support and subsidies in agriculture and rural development in Slovakia. The European Commission (EC) has been alerted to the EPPO about the negative impact of the legislative changes on the overall level of protection of the EU's financial interests in Slovakia. This is reported by the Brussels-based TASR correspondent. The report states that the European Chief Prosecutor Laura Kövesi addressed a letter to the European Commission on Monday (1 June) in accordance with recitals 9, 16 and 17 of the 2020 EU Regulation on the general system of conditionality for the protection of the European Union budget (the Conditionality Regulation). According to the EPPO report, the letter is also justified under Article 14 of the Agreement on the Methods of Cooperation between the EC and the EPPO. The document sent to the EU executive draws attention to recent legislative changes in the area of ​​providing support and subsidies in agriculture and rural development in Slovakia. According to the EPPO’s announcement, the European Chief Prosecutor, based on a thorough analysis of the new Slovak legislation, concluded that it contains several elements that “significantly reduce the effective protection of the EU’s financial interests” as well as national financial interests. In particular, the legislative changes have reduced the possibility of imposing effective administrative measures during criminal proceedings, in the period between indictment and final conviction. As a result, the ability of the responsible authorities to suspend agricultural subsidies (payments) to beneficiaries accused of a crime has been significantly limited. The European Chief Prosecutor informed the EC that these legislative changes have a negative impact on the overall level of protection of the EU’s financial interests in Slovakia.
