Bilateral agreements with EU law should end

Bilateral investment agreements for the protection and promotion of investments concluded between Member States of the European Union (EU) should be definitively terminated. This should eliminate the conflict of bilateral agreements with EU law. This stems from the proposal to conclude an agreement on the termination of these contracts submitted by the Ministry of Finance (MF) of the Slovak Republic for Wednesday (5 February) The proposal represents the implementation of the judgment of the Court of Justice of the EU of 6 March 2018 in the case of Achmea v. The Slovak Republic (Achmea decision). The EU Court of Justice has ruled that the system of arbitration between investor and state, as established through bilateral agreements on the protection and promotion of investments concluded between EU Member States, is incompatible with EU law. All Member States of the Union are required to draw the consequences of this Decision. .odkaz na stránku
