The protection of the highest quality agricultural land from takings should be increased. This follows from the draft amendment to the government regulation on levies for the withdrawal and unauthorized taking of agricultural land from the Ministry of Agriculture and Rural Development (MPRV) of the Slovak Republic submitted to the interdepartmental comment procedure (MPK). The government regulation should come into force on April 1.
"The aim of the draft government regulation is to increase the protection of the highest quality agricultural land from takings. This increase in protection is achieved by extending the legal protection of agricultural land to all agricultural land of the highest quality (not only to selected lands in individual cadastral areas) and by adjusting the obligation to pay the levy for the withdrawal of agricultural land for all agricultural land according to their quality," the agricultural sector specified.
According to the MPRV, the draft regulation simplifies and makes more transparent the exemption from paying the levy for existing family houses. In connection with the new legal regulation in the construction sector, the category of family houses is being abolished and replaced by a broader category of residential buildings. The purpose of the exemption from paying the levy should therefore apply to residential buildings regardless of whether they are in the original category of family houses (residential buildings with a maximum of three apartments on a maximum of two floors) or residential buildings with multiple apartment units on multiple floors.
"For the protection of agricultural land, the essential parameter is the area of the land, not the floor area of the building. The area is unified at 200 square meters (m2), representing the average value between the previously established values of 150 m2 for two-story family houses and 250 m2 for family houses with one floor," the Ministry of Agriculture added in the explanatory report to the proposal.
