The new construction law will enter into force on April 1st.

A new building law will come into force on April 1. Its aim is to professionalize the state building administration, reduce the administrative burden on doing business, and simplify the construction process, especially for family houses and small apartment buildings. The law also addresses the issue of so-called illegal construction and the reduced level of discipline in construction. The new building law is intended to significantly reduce the administrative burden and simplify the process of building permits. The new legislation from the Ministry of Transport (MT) of the Slovak Republic introduces a new definition of small buildings and expands the scope of simple buildings. A system of a single administrative procedure will also be introduced and clear deadlines for the actions of the building authority will be set. Small structures such as summer kitchens, sheds or garages or carports with a built-up area of ​​up to 50 square meters (m 2 ), swimming pools up to 25 m2 or, for example, photovoltaic devices with an output of up to 100 kW will no longer need to be notified unless they are in public areas or within two meters of neighboring land. In the new construction legislation, the agenda of the building authority remains with the municipalities, which, however, can establish building districts similarly to the current joint municipal authorities. The protection of works of art in buildings and in public areas from damage or destruction by construction activities is also regulated on the basis of European conventions. The so-called fiction of consent is also introduced, i.e. if the municipality does not issue a binding opinion within the specified period, this will be considered consent. The Construction Act was finally approved by the members of the National Council of the Slovak Republic on February 5, 2025. In an abbreviated legislative procedure, the Parliament also approved the Act on Amendments to Certain Acts in connection with the changes brought about by the Construction Act. odkaz na stránku
